Amenity Access

Pool

  • What are the operating hours of the pool?
     Pools close at 10PM daily. After posted hours, pool use is subject to trespassing law enforcement.
  • Are pool/cabana reservations allowed?
     Pools and cabanas are not available for reservations or rentals.
  • What are the pool rules?
     Only regular swimming suits and colorfast T-shirts for sun protection are allowed. No cutoffs, glass, pets, or improper conduct. Lifesaving equipment is for emergencies only. Please clean up after use and lock restrooms when leaving.

Architectural

  • What types of exterior modifications can I make to my home without requiring approval?
     No landscaping, building, fence, wall, or other structure may be commenced, erected, or maintained, nor any exterior addition or modification, until plans and specifications are submitted and approved by the ACC Committee. 
  • Where do I find the architectural modification request form?
     Contact the management company for the form and submission instructions.
  • How long does approval take?
     The Board or its designated committee will review submissions. Please allow up to 30 days for a response.
  • What is the status of my application?
     If you have not received a response within 30 days, contact the management company.

Meetings

  • How do I find out when the next Member or Board meeting takes place?
     The first semi-annual meeting is held in May (for Board elections); the second in November (for budget/assessments). Notice is provided in January and updated in the newsletter. Special meetings may be called as needed[3].

Common Area Maintenance

  • What am I responsible for maintaining?
     Owners are responsible for their own unit’s maintenance. The Association maintains common elements such as roads, pools, parking areas, exterior surfaces, entrances, and lawn areas. Use of common elements is restricted to their intended purposes[2].
  • How do I report a maintenance issue?
     Contact the management company.
  • What is the trash/waste pick-up schedule?
     Tuesday & Friday

Compliance

  • I received a violation notice. Who can I talk to?
     Contact the management company. Owners are entitled to notice and an opportunity to cure most violations. Fines may be levied if not cured. Owners have the right to request a hearing within 30 days of notice[4].
  • How are fines assessed?
     Fines may be levied for violations, including failure to provide proof of insurance or annual contact sheet ($50/month), parking violations, and other rule infractions. The Board may pursue legal action for unresolved violations[4].
  • How do I appeal a violation or fine?
     Submit a written request for a hearing within 30 days of the violation notice. Hearings are held privately, and the Board will provide a written decision[4].

Financial

  • When is my assessment due?
     Assessments are due on the 1st of each month. Payments not received by the 15th are delinquent and subject to a $25 late fee and 8% annual interest[5].
  • What happens if I don’t pay my assessment?
     Delinquent accounts are subject to late fees, interest, and possible legal action, including foreclosure. The Association will send notices and may offer payment plans under certain conditions[5].
  • How are payments applied?
     Payments are applied to delinquent assessments, current assessments, attorney’s fees, fines, and other amounts owed, in that order[5].
  • Can I set up a payment plan?
     Payment plans are available but must be in writing and meet minimum terms. Defaulting on a plan may result in immediate legal action[5].
  • What is my assessment paying for?
     Assessments fund the operation, maintenance, and repair of common areas and facilities[6].
  • Are there late fees or interest?
     Yes. $25 late fee if not paid by the 15th, and 8% annual interest if not paid within 30 days[5].

Insurance

  • What insurance am I required to carry?
     Owners must purchase and provide proof of insurance for full replacement coverage on the dwelling and detached garage (garage/other structures coverage should be at least 10% of dwelling coverage). Failure to provide proof results in a $50/month fine and possible legal action[7].
  • What if I don’t provide proof of insurance?
     The Association may purchase insurance on your behalf and charge your account. This debt is subject to interest and collection as with assessments[7].

Owner Information

  • How do I update my contact information?
     Owners must complete an information sheet within 30 days of ownership and update within 30 days of any changes. Annual verification is required[8].

Resales

  • How do I obtain a resale certificate?
     Request in writing from the management company. The certificate will be provided within 10 days. Fees are the responsibility of the requesting party[8].

Documents

  • Where can I find the governing documents?
     The Declaration, By-Laws, and Rules & Regulations are available for inspection at the management company’s office. Copies may be purchased at reasonable cost[9].

Parking

  • What are the parking rules?
     Resident vehicles must be parked in the garage. No parking in guest spaces except as permitted. Permits are required for third vehicles. Violations may result in fines or towing[10].

Pets

  • Are pets allowed?
     Only dogs, cats, and other common household pets (maximum two adult animals) are allowed. No livestock, poultry, or snakes. Pets must not be a nuisance and must be leashed. Owners must clean up after their pets[2].
